USCIS, the U.S. Citizenship and Immigration Services, has announced that effective the first of January 2010 all foreign documents submitted to them will need to be translated into English by a USCIS approved translation service (link).

Translation services are already familiar to most people since they provide written material in one language translated into another. However, until now many foreign documents were allowed to be notarized without any USCIS Approved Translation Services ā€“ although it was always advisable for applicants to get their birth certificates or other important documents translated before using them as supporting evidence because of this added credibility.

The new policy comes hot on the heels of changes made at INS, which is now called USCIS (see our article INS vs USCIS ). It seems that these changes are intended to make it easier for INS (now called USCIS) to spot fraudulent documents.

Just about any document can be submitted as evidence of eligibility to work, acquire U.S. citizenship or even prove your identity, but having these documents in English makes life a lot easier for both the American adjudicating officer and you the applicant trying to prove that you deserve what you are asking for.

Here is what USCIS has to say on its website: ā€œTranslations are accepted only from designated translation companiesā€. The same article goes on to state ā€œOnly designated translation companies may translate foreign language documents into English for USCISā€.

Translation services must be approved by the agency because they have undergone rigorous testing and evaluations which proves their expertise in both English and the foreign language.

Wherever there are government agencies handling immigration, visa, or citizenship requests you will find that they have an approved list of translators which you can use to be sure of avoiding any problems with your documents. But remember it is always better to check before you make final arrangements for your translation.

As long as you have obtained your original documentation from a reliable source (such as your local embassy) and had them translate and validate it before sending it into USCIS (even though they did not ask for any translation), you should have nothing to fear. You can easily replace your documentation by going back to the same original source and requesting a copy of the English translation, certified either by that embassy or by a USCIS approved translation service.
